1. About Blackwing
Blackwing is a brand owned and operated by Watters and Kin LLC, the holding company responsible for all services, contracts, and commercial arrangements offered under the Blackwing name. Any reference to "Blackwing", "we", "us", or "our" in these Terms refers to Watters and Kin LLC trading as Blackwing.
2. Acceptance of terms
By accessing this website, submitting an enquiry, or engaging Blackwing for services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the site or our services.
3. Services
Blackwing provides marketing, design, AI strategy, and digital execution services. Scope, deliverables, timelines, and fees for each engagement are defined in a separate proposal, statement of work, or written agreement between the client and Watters and Kin LLC.
4. Payments
Fees are payable in accordance with the terms set out in the applicable proposal or invoice. Unless otherwise stated, invoices are due on receipt. Late payments may incur interest and suspension of ongoing work at Blackwing's discretion.
5. Intellectual property
All pre-existing intellectual property, methodologies, frameworks, and tools used by Blackwing remain the property of Watters and Kin LLC. Ownership of final deliverables transfers to the client upon full payment, unless otherwise agreed in writing.
6. Confidentiality
Both parties agree to keep confidential any non-public information shared during an engagement and to use it only for the purpose of delivering or receiving the agreed services.
7. Limitation of liability
To the fullest extent permitted by law, Watters and Kin LLC's total liability arising out of or in connection with any engagement shall not exceed the fees paid by the client for the specific services giving rise to the claim. Blackwing is not liable for indirect, incidental, or consequential losses.
8. Data & privacy
Information submitted via forms on this website is stored securely and used solely to respond to enquiries or deliver requested services. We do not sell or share your data with third parties for marketing purposes.
9. Changes to these terms
Blackwing may update these Terms from time to time. The latest version will always be available on this page with a revised "last updated" date.
